TERMS & CONDITIONS

1. DEFINITIONS

1.1 “The Heath²” / “Studio” / “Company”

Refers to Camera Work London Limited, trading as “The Heath²,” including directors, partners, employees, subcontractors, and agents acting on its behalf.

1.2 “Customer” / “Client” / “Hirer”

Any person, firm, or company booking or using the Studio, including their employees, agents, or guests.

1.3 “Services”

All services offered by The Heath², including hire of the Studio space and any related equipment or staff.

1.4 “Equipment”

All fixtures, fittings, props, lighting, and other materials provided or arranged by The Heath².

1.5 “Booking”

A confirmed reservation of the Studio (and/or Equipment) for a specified date and time.

1.6 “Rate Card”

Any published or quoted pricing list detailing current fees (e.g., hire rates, overtime charges, cleaning fees).

2. BOOKING & CONFIRMATION

2.1 Booking Requests & Written Confirmation

• All bookings must be confirmed in writing prior to the rental.

• Confirmation is made by completing the online confirmation form; only completed forms guarantee availability.

• A booking is secured only once full payment has been received (unless otherwise agreed in writing).

2.2 First & Second Options

• First Option and Second Option are provisional holds that do not guarantee availability until the Booking is confirmed.

• If a Second Option holder wishes to confirm, the First Option holder will be notified and given a fair and reasonable amount of time to confirm or release the date.

• To hold a date without losing First Option status, the Customer must pay 50% of the total hire fee. Failure to pay the deposit may result in the date being released or given to another Customer holding a Second Option.

2.3 Duration of Options

• Studio options (pencils) will be held for a maximum of two weeks.

• Any unconfirmed holds 48 hours prior to the proposed shoot date may be released at The Heath²’s discretion.

2.4 Exclusivity

• The Studio is available only for the exclusive use of the Customer named in the booking.

• Sub-contracting, sub-letting, or sharing the Studio or Equipment with third parties is not permitted without prior written consent.

3. PAYMENT

3.1 Payment Requirements

• Full payment is required prior to the studio rental unless otherwise agreed in writing.

• Rates cover studio hire only; additional services (equipment rental, assistants, catering, etc.) are invoiced separately.

•The Customer shall pay 100% of the Charge agreed for the hire of the Venue for the Hire Period.

3.2 Overdue Payments & Interest

• Overdue amounts may accrue interest at 8% per annum above the Bank of England base rate, calculated daily from the due date until cleared.

• All rates are exclusive of VAT unless otherwise stated.

3.3 Damage Deposit

• For certain hires, The Heath² may require an additional damage deposit (minimum £200+VAT).

• If no damages or outstanding charges arise, this deposit will be refunded within 48 hours (or up to 5 working days) following the booking, once the Studio and Equipment have been inspected.

4. CANCELLATIONS & RESCHEDULING

4.1 Final Bookings

• All bookings are final. No refunds or date transfers apply unless otherwise agreed in writing.

4.2 Cancellation Charges

• A 50% cancellation charge applies if a confirmed booking is canceled 3–5 working days (Mon–Fri) before the start date.

• A 100% charge applies if a booking is canceled within 3 working days of the start date, plus any costs incurred (e.g., hired equipment fees).

•Bookings made at a discounted rate can only be rescheduled .

•“Commercial Rate” is classified at the discretion of The Heath² depending on the type of shoot and the number of people within the booking.

•The Studio reserves the right to Reschedule, Cancel, or Refund any booking.

5. STUDIO HOURS & OVERTIME

5.1 Operating Hours

• Standard hours are 8am – 6pm.

• A standard “full day” hire is 8 hours within these times.

5.2 Overtime Billing

• Overtime is billed hourly if the Studio is used beyond booked hours, with a 1-hour minimum charge.

• Overtime Rates:

6–7am & 9–11pm: £150 + VAT per hour.

11pm–2am: £250 + VAT per hour.

After 2am: by arrangement only.

• Pre-booked between 6–9pm: discounted, non-refundable rate of £120 + VAT per hour.

5.3 Setup & Takedown

• The Customer must include setup, breakdown, and clean-up within their booked hours. Failing to do so will incur overtime charges.

6. STUDIO USE

6.1 Studio Condition & Alterations

• The Studio must be left in the same condition in which it was found.

• Any damage, mess, or unauthorised alterations will result in additional charges.

• No alterations, decorations, or additions to the Studio are permitted without The Heath²’s written consent.

6.2 Smoking & Restricted Activities

• Smoking, vaping, illegal activities, and unauthorised use of smoke or haze machines are strictly prohibited.

• Noise must be kept at a respectful level due to neighboring residents.

6.3 Furniture & Surfaces

• The Heath² furniture or fridges must not be moved without the agreement and supervision of staff.

• No adhesive tapes are allowed on floors, coves, furniture, or walls. The Customer will be liable for any repair costs if damage occurs.

6.4 Infinity Cove & Walls

• The cove is supplied painted white by default. Repainting in alternative colors is an additional cost and must be agreed upon in writing.

• At the end of each hire, the cove is returned to its original state; any repair, painting, or restoration costs arising from the booking will be charged to the Customer.

6.5 Set Construction Materials

• All set-building materials or products must be removed from the Studio by the end of the booking.

• Any materials or products left behind will be disposed of at the Customer’s cost.

6.6 CCTV & Security

• CCTV is in operation for safety and to support damage claims. Any tampering with CCTV systems will result in immediate termination of the booking without refund.

7. PARKING

7.1 Advance Arrangement

• All parking requirements must be communicated in advance to ensure availability.

7.2 Complimentary Space

• One (1) vehicle may park free of charge in Bay 2 during the booking.

7.3 Additional Vehicles

• Up to 2 extra cars may be accommodated (subject to space) at £15 per day per vehicle.

• Unapproved vehicles may be refused entry or removed at the owner’s risk.

8. EQUIPMENT HIRE

8.1 Risk & Responsibility

• Equipment is hired at the Customer’s own risk and must be returned in good condition.

• The Customer is responsible for any damage, theft, or loss of hired equipment.

8.2 Equipment Orders & Availability

• Equipment lists must be confirmed by 12 noon the day prior to the shoot. Late requests may result in unavailability or delivery delays.

• The Heath² does not allow third-party rental companies to supply equipment without prior written permission. Non-adherence may incur additional charges.

8.3 Damage Waiver & Insurance

• A Damage Waiver Fee / equipment insurance fee is mandatory unless valid insurance is provided in advance. It covers accidental damage, with a £300 excess per claim.

• Equipment must not be altered, removed from the premises, or operated by untrained personnel.

8.4 Liability

• The Heath² is not responsible for loss or damage to personal or hired equipment. Any property left on the premises is at the Customer’s own risk.

9. LIABILITY & INSURANCE

9.1 Use at Own Risk

• The studio and equipment are used at the Customer’s own risk. The Heath² accepts no responsibility for loss, damage, injury, or delay caused by third parties, weather, power outages, or force majeure.

9.2 Public Liability

• The Customer must hold appropriate public liability insurance for all persons involved and, where applicable, coverage for hired equipment.

• The Heath² reserves the right to inspect insurance policies or request deposits as required.

9.3 Personal Property

• Any items left behind after a booking will be disposed of or donated 48 hours later if not collected. The Heath² is not liable for any resulting loss.

10. DELIVERIES, STORAGE & WASTE

10.1 Deliveries & Collections

• Deliveries and collections are accepted up to 24 hours before or after a booking, by agreement.

• Items must be clearly labeled. Storage outside these times is not guaranteed and may incur fees.

10.2 Waste & Cleanup

• Standard waste bins are provided. Additional or excessive waste removal must be arranged in advance and may incur extra charges.

• If the Studio is not left in acceptable condition, a cleaning charge starting at £80+VAT will be added to the Customer’s invoice.

10.3 Concierge Charge

• Any items arriving at or remaining in the Studio outside agreed hours may be subject to a concierge/storage fee.

• The Heath² accepts no liability for loss or damage to items left on the premises.

11. DAMAGES & EXTRA FEES

11.1 Damage Liability

• Customers are liable for any damage to the Studio, fittings, or equipment. Repairs or replacements will be charged in full, plus a 25% admin fee where applicable.

11.2 Infinity Cove

• Repainting or repair costs for the cove will be quoted as needed and charged to the Customer if damages occur.

11.3 Specialist Cleaning & Redecorating

• Any specialized cleaning, rubbish removal, or redecorating required after the booking will be billed post-booking and itemized in the final invoice.

11.4 Continuous Lighting Surcharge

• A £55 per day surcharge may apply for continuous lighting or HMI use.

12. DATA PROTECTION & PRIVACY

12.1 Compliance

• The Heath² processes personal data in accordance with the UK GDPR and the Data Protection Act 2018.

12.2 Usage & Retention

• Customer data is used to manage bookings, process payments, and communicate relevant offers or changes.

• CCTV footage may be retained for a limited period for security or investigatory purposes.

12.3 Privacy Policy

13. HARASSMENT & DISCRIMINATION

13.1 Zero-Tolerance Policy

• The Heath² does not tolerate harassment or discrimination on any grounds, including sexual orientation, race, gender, or religion.

• Harassment includes creating an offensive, intimidating, or humiliating environment for staff, suppliers, or other individuals onsite.

13.2 Breaches & Consequences

• The Heath² reserves the right to request any person or production to leave immediately if they breach this policy.

• No compensation or refund will be provided under such circumstances.

14. TERMINATION

14.1 Grounds for Termination

The Heath² reserves the right to terminate any booking or agreement immediately if:

1. The Customer fails to pay amounts when due.

2. The Customer is in significant breach of these Terms & Conditions.

3. There is a risk to safety, security, or property.

14.2 Effect of Termination

• Upon termination, the Customer must promptly vacate the Studio and remove any property.

• All fees paid may be forfeited, and The Heath² may seek further damages or costs.

15. ENTIRE AGREEMENT

15.1 Complete Agreement

These Terms & Conditions, together with any Booking Confirmation, Quotation, or Invoice, represent the entire agreement between The Heath² and the Customer concerning the subject matter.

15.2 Severability

Should any provision in these Terms & Conditions be deemed unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
